Tour Boston Now Promotional Sweepstakes Official Rules

1. Sponsor

The sponsor of this promotion is Tour Boston Now LLC (the "Sponsor").

2. Promotion Type

All promotions are conducted using a sweepstakes format. No purchase, payment, donation, or other consideration is necessary to enter or win. A purchase or payment will not improve an entrant's chances of winning.

3. Eligibility

Sweepstakes offered by the Sponsor are open only to legal residents of the United States who are at least 18 years old at the time of entry, excluding residents of jurisdictions where the promotion is prohibited by law. Employees, officers, directors, members, managers, agents, and representatives of Sponsor, its parent companies, affiliates, subsidiaries, advertising or promotion agencies, and immediate family members or persons living in the same household of any such individual are not eligible to enter or win.

4. Promotion Period

Start and end times of each sweepstakes offered by the Sponsor will be listed on the official Tour Boston Now website and may also be included in the initial promotional announcement. All posted times are Eastern Time. The stated start date and time together with the stated end date and time constitute the Promotion Period. Entries submitted before or after the Promotion Period are not eligible.

5. How to Enter

During the Promotion Period, eligible individuals may enter by completing any one of the following free entry methods designated by Sponsor on the Tour Boston Now website:

• submitting the online entry form on the Tour Boston Now website; or

• completing any other free method of entry specifically described on the official promotion landing page.

If Sponsor promotes the sweepstakes on social media, use of social media is not required to enter unless a fully free, legally compliant method of entry is also provided on the website. Limit one entry per person and per email address unless the promotion page expressly states a different limit.

Entries generated by script, bot, macro, artificial intelligence agent acting without human completion of the required entry process, or other automated or mechanical means are prohibited and may be disqualified. In the event of a dispute as to the identity of an entrant or potential winner associated with an email address, social media account, or other identifier, Sponsor may deem the entry to have been made by the natural person who is the authorized account holder of the email address or account used at entry, subject to verification of eligibility and compliance with these Official Rules.

6. No Purchase Necessary; No Consideration

This sweepstakes is intended to remove consideration so that the promotion does not become an unlawful lottery. Entrants must not be required to buy anything, pay money, provide any item of value, or undertake burdensome activity as a condition of entry or winning. Sponsor will not give any entrant who makes a purchase, buys a tour, or engages in other paid activity any advantage in odds of winning over entrants who use the free method of entry.

7. Prize Description

One or more winners will receive the prize or prizes described on the official promotion page. The number of prizes, a description of each prize, any material restrictions, and the approximate retail value of each prize must be stated clearly on that page and are incorporated into these Official Rules by reference. No substitution, transfer, or cash redemption is permitted except by Sponsor, which reserves the right to substitute a prize of equal or greater value if an advertised prize becomes unavailable.

Prizes may include tickets to sporting events or other live events, including, by way of example only, tickets to games or events involving the Boston Red Sox, Boston Celtics, Boston Bruins, New England Patriots, or other professional, collegiate, or entertainment events, together with any related ticket package details specifically described on the applicable promotion page. All seat locations, game dates, opponents, event dates, admission terms, and delivery methods are subject to availability, venue rules, ticket issuer terms, league policies, scheduling changes, postponement, and cancellation.

Tour Boston Now is the sole sponsor of the sweepstakes unless expressly stated otherwise. The Boston Red Sox, Boston Celtics, Boston Bruins, New England Patriots, Major League Baseball, the National Basketball Association, the National Hockey League, the National Football League, their member clubs, event venues, ticketing providers, and each of their respective parent companies, affiliates, subsidiaries, officers, directors, employees, and agents are not sponsors of, do not endorse, are not affiliated with, and are not administering this promotion unless Tour Boston Now expressly states otherwise in writing.

Any trademarks, trade names, team names, league names, logos, service marks, venue names, and other identifying materials referenced in connection with a prize are used solely to describe the prize and remain the property of their respective owners. Sponsor may substitute comparable tickets or another prize of equal or greater value if a described event, team appearance, or ticket package becomes unavailable for any reason.

Unless the applicable promotion page expressly states otherwise, each winner is solely responsible for all costs and expenses associated with acceptance and use of the prize that are not specifically described as being provided by Sponsor, including transportation, lodging, parking, meals, gratuities, incidental expenses, and personal expenditures. Any guest accompanying a winner must satisfy any age or attendance requirements stated on the promotion page, in venue policies, or in applicable ticket terms; if a guest has not reached the age of legal majority in the guest's jurisdiction of residence, the guest must be accompanied by a parent or legal guardian unless the applicable promotion page expressly permits otherwise. Use of event tickets or admissions awarded as a prize is subject to all terms, conditions, restrictions, health and safety requirements, and codes of conduct established by the issuing team, league, venue, or ticket provider. Tickets and related prize components may not be sold, resold, offered for resale, bartered, auctioned, or used for commercial or promotional purposes unless Sponsor expressly authorizes that use in writing. Sponsor and the applicable venue or event operator reserve the right to remove, deny entry to, or disqualify any winner or guest who violates venue rules or engages in unsafe, unlawful, disruptive, abusive, or unsportsmanlike conduct. If any game, event, or related experience is postponed, delayed, suspended, or cancelled due to weather, public health concerns, venue decisions, league action, force majeure, or other reasons beyond Sponsor's reasonable control, Sponsor may, in its sole discretion, substitute a comparable prize, reschedule fulfillment if feasible, or award the remaining portion of the prize without further liability, subject to applicable law.

8. Odds of Winning

The odds of winning depend on the number of eligible entries received during the Promotion Period.

9. Winner Selection

After the Promotion Period has ended, Sponsor or its designated administrator will select the potential winner or winners in a random drawing from among all eligible entries received. The random drawing method will be final and binding, subject to verification of eligibility and compliance with these Official Rules.

10. Winner Notification and Claim

Potential winner(s) will be notified by email, telephone, direct message, or other reasonable method using the contact information provided at entry.

A potential winner must respond to Sponsor's initial notification within the time expressly stated in the publication of the winner’s name and must timely provide any information and documentation reasonably requested by Sponsor to confirm identity, eligibility, and ability to accept the prize. Sponsor may require a potential winner, and where applicable a guest, to sign and return an affidavit or declaration of eligibility, liability release, publicity release, tax form, guest release, travel acknowledgment, or other prize-claim documentation as a condition of confirmation. If a potential winner cannot be contacted, fails to respond within the required time, refuses the prize, fails to sign or return required documents, provides inaccurate information, is found to be ineligible, or otherwise does not comply with these Official Rules, Sponsor may disqualify that potential winner and may select an alternate potential winner from the remaining eligible entries, time permitting.

For entrants in New Hampshire, any prize or gift will be delivered free of charge within 10 days after announcement of the winner, consistent with applicable New Hampshire sweepstakes guidance.​

11. Taxes

Winners are solely responsible for all federal, state, and local taxes associated with acceptance or use of any prize. If required by applicable law, Sponsor will collect a completed IRS Form W-9 and may issue an IRS Form 1099 or other tax reporting form to the winner and the Internal Revenue Service based on the fair market value of the prize and applicable reporting thresholds.

12. Publicity Release; Name, Image, and Likeness

Except where prohibited by law, acceptance of a prize constitutes the winner's consent for Sponsor and its designees to use the winner's name, city and state of residence, social media handle, photograph, voice, image, statements, and likeness for advertising, publicity, trade, and promotional purposes in any media now known or later developed, including on Sponsor's website, email marketing, and social media channels, worldwide, in perpetuity, without further notice, review, approval, or additional compensation.

As a condition of being confirmed as a winner, Sponsor may require the winner to sign a written publicity, liability, and eligibility declaration to document that consent, except to the extent prohibited by applicable law.

Sponsor may record, photograph, film, interview, quote, and otherwise capture a winner's participation in prize-related activities and may edit, adapt, combine, publish, display, distribute, and reuse those materials together with the winner's name, likeness, voice, biographical details, social media identifiers, and statements for commercial and promotional purposes related to Sponsor's business, services, events, and brand campaigns, without additional compensation, except where prohibited by law. To the extent permitted by law, the winner waives any right to inspect or approve finished advertising or promotional materials incorporating those items.

13. Social Media Disclosures

If the sweepstakes is advertised or administered through social media platforms such as Instagram, Facebook, TikTok, X, or similar services, the promotion is in no way sponsored, endorsed, administered by, or associated with those platforms unless expressly stated otherwise. Entrants must comply with the terms, rules, and policies of each applicable platform. If an entry method requires an entrant to post or share content about Sponsor or its services, Sponsor will instruct entrants to disclose the material connection to the promotion clearly, such as by using an appropriate disclosure like #sweepstakes or #contest where required for transparency under FTC principles.

14. Compliance With Federal and state Law; geographic eligibility

Sponsor intends this promotion to comply with applicable federal law and the laws of the states in which the sweepstakes is offered. Unless the applicable promotion page expressly states a narrower eligibility area, the sweepstakes is open to eligible legal residents of the fifty (50) United States and the District of Columbia, excluding any jurisdiction where the promotion is prohibited or restricted by law. These Official Rules must be interpreted so that the promotion does not require payment or other unlawful consideration in exchange for a chance to win a prize, and Sponsor will not structure or market the promotion in a way that causes a gambling purpose to predominate over a bona fide promotional activity.

Notwithstanding the foregoing, residents of Rhode Island are not eligible to enter or win any sweepstakes, drawing, or prize giveaway sponsored by the Sponsor if the total announced value of the applicable prize or prize pool is $500 or greater, for compliance purposes. For promotions with a total announced prize value below $500, Rhode Island residents may be eligible unless the applicable promotion page states otherwise.

Sponsor will not conduct or promote this sweepstakes through any prohibited electronic machine or entertaining display in Massachusetts. Sponsor also reserves the right to void, cancel, suspend, modify, or limit the promotion in any state or jurisdiction if fraud, technical failures, legal issues, or other causes impair the integrity or lawful administration of the promotion, or if additional registration, bonding, filing, or disclosure obligations would apply.

15. Data and Privacy

Information collected in connection with the sweepstakes will be used by Sponsor for administration of the promotion and as otherwise described in Sponsor's privacy policy. By entering, entrants agree that Sponsor may contact them regarding the promotion and, if the entrant separately opts in, for marketing communications. Entry into the sweepstakes should not be conditioned on consent to marketing messages beyond what is necessary to administer the promotion.

By submitting an entry, an entrant authorizes Sponsor and its service providers, agents, and promotion administrators to use the entrant's contact and submission information for purposes of administering the sweepstakes, verifying eligibility, communicating about winner selection, prize fulfillment, compliance, and related customer support. If Sponsor offers a separate checkbox, signup form, or comparable affirmative consent mechanism for newsletters, promotional emails, text messages, or other marketing communications, that consent is optional, separate from entry, and may be withdrawn at any time in accordance with the instructions provided in the communication or as otherwise required by law. Choosing not to opt in to marketing will not reduce an entrant's chances of winning.

16. General Conditions

Sponsor reserves the right to disqualify any individual who tampers with the entry process, violates these Official Rules, acts in a disruptive or unsportsmanlike manner, or attempts to undermine the legitimate operation of the sweepstakes. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, misdirected, or technically corrupted entries or communications. Sponsor's decisions on all matters relating to the sweepstakes are final and binding, subject to applicable law.

Sponsor and the Released Parties are not responsible for interrupted or unavailable networks, servers, internet service providers, websites, apps, platforms, telephone systems, mobile carriers, hardware, software, viruses, bugs, malware, unauthorized intervention, human error, transmission failures, delivery failures, or other technical or administrative problems that may affect entry, notification, verification, or prize fulfillment. Sponsor may void any suspect entry, disqualify any person who attempts to falsify information or interfere with the proper operation of the sweepstakes, and pursue any remedy available at law or in equity against any person who deliberately damages any website, platform, system, or promotional asset or who attempts to commit fraud, hacking, deception, or other abuse in connection with the promotion.

If, for any reason, the sweepstakes cannot be conducted as planned, or if Sponsor determines in its sole discretion that the administration, security, fairness, integrity, or proper operation of the sweepstakes has been compromised by technical failures, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, force majeure, legal developments, public safety concerns, or any other cause beyond Sponsor's reasonable control, Sponsor reserves the right, subject to applicable law, to cancel, suspend, modify, shorten, extend, or terminate the sweepstakes, in whole or in part. In such circumstances, Sponsor may select winners from among eligible, non-suspect entries received before the action taken, may decline to award all or part of a prize where fulfillment is no longer feasible, and may post notice of any material change on the applicable promotion page or other reasonable channel.

17. Release and Limitation of Liability

By participating, entrants agree, to the fullest extent permitted by law, to release and hold harmless Sponsor and its parent companies, affiliates, subsidiaries, advertising and promotion agencies, social media platforms, and each of their respective officers, directors, employees, and agents from and against any claim or cause of action arising out of participation in the sweepstakes or receipt, use, or misuse of any prize, except for liability that cannot be waived under applicable law.

For purposes of these Official Rules, "Released Parties" means Sponsor, its parent companies, affiliates, subsidiaries, members, managers, officers, directors, employees, contractors, representatives, advertising and promotion agencies, prize suppliers, ticket providers, venues, leagues, teams, social media platforms, technology vendors, and each of their respective successors and assigns. By entering, each entrant, on behalf of the entrant and the entrant's heirs, executors, administrators, and assigns, releases and agrees to hold harmless the Released Parties from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses arising out of or relating to participation in the sweepstakes; the acceptance, possession, use, misuse, or inability to use any prize; attendance at, travel to or from, or participation in any prize-related event or activity; any postponement, cancellation, or modification of a prize-related event; and any publicity, recording, or promotional use permitted under these Official Rules, except to the extent caused by a Released Party's gross negligence, willful misconduct, or other liability that may not be waived by law.

18. Disputes and Governing Law

Except where prohibited, entrants agree that all disputes, claims, and causes of action arising out of or connected with this sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and governed by the laws of the State of New Hampshire, without regard to conflict of law principles, provided that nothing in these Official Rules limits any non-waivable rights under Massachusetts consumer protection law for Massachusetts residents.

19. Winner List

For the name of the winner(s), email a request to promotions@tourbostonnow.com with a subject line of "Tour Boston Now Winner List Request." Requests must be received within 30 days after the end of the Promotion Period.

20. Void Where Prohibited

This sweepstakes is void where prohibited or restricted by law and is subject to all applicable federal, state, and local laws, rules, and regulations.
